| Returning a Product: If our products do not meet your expectations for some reason you can revoke the order within 14 days after receipt of the product(s). You can revoke the order in writing (letter, fax or E-Mail) or by returning the product(s). The date of the return shipment must be within the return period. If you return an item please include a short note stating your wish to step back from the purchase. Any product that can be shipped in a packet must be returned to us by the customer. Return shipping costs have to be paid by the customer, if: - the product value is up to and including EURO 40.- or - the product value is above EURO 40.- and the customer has not or has only partially paid the full amount at the time of the cancellation of the order. Return shipping costs AND the original shipping costs must be paid in full by the customer if the item has not been paid by the time of the return. Excepted are cases where the delivered product is proved not to be identical to what you ordered. In case of deterioration of the product we claim compensation. In order to avoid such claims we recommend to avoid anything that might influence the value of the product. Custom made products as well as any products that differ from the normal scope of delivery are excepted from the right to return. |

Terms and Conditions of the Company Teleskop-Service Ransburg GmbH § 1. General (1) These Terms and Conditions regulate the contracts between the customer and the company Teleskop-Service Ransburg GmbH concerning delivery and services by the company Teleskop-Service Ransburg GmbH. (2) Different conditions set by the customer shall be void. They shall also be void if Teleskop-Service does not explicitly state its disagreement with such terms and conditions or makes delivery or services without reservations. (3) All offers are not binding and subject to confirmation. They are valid for two weeks at most. After this period offers need to be confirmed. § 2. Forming the Contractual Relationship (1) The contractual relationship is formed through a written, verbal or electronical (E-mail, fax) order by the customer from the company Teleskop-Service and is based solely on the regulations stated in these Terms and Conditions. (2) Teleskop-Service explicitly reserves the right to immaterial changes in the contract which can be justified before the customer. § 3. Delivery Regulations (1) All services required of Teleskop-Service to the customer are set in the order. (2) Any delivery times stated by Teleskop-Service are stated with reservations due to the dependance on suppliers. Teleskop-Service cannot be held liable for delivery times. (3) In case of wrong delivery the customer has the right to demand correction. Immaterial changes to the product design which do not affect the operation and general performance significantly are allowed in the context of product improvements and do not have to be indicated separately. (4) In case of considerable exceedance of delivery time which cannot be tolerated by the customer the customer has the right to withdraw from the contract. (5) Unless a different agreement is made delivery is paid through Paypal, pre-payment, cash on delivery or payment by credit card. Shipping costs are detailled on the invoice and are added to the price of the product(s). (6) Teleskop-Service is not obliged to split shipments. We nonetheless try to ascertain quickest possible delivery. True subsequent deliveries of items not available at the time of the first shipment are free of shipping charges. If the customer changes the order or adds products to the order before the subsequent shipment takes place the shipping costs will be charged. (7) All offers are not binding. Price increases are possible. The customer is not obliged to accept a price increase. § 4. Order Confirmation / Validity (1) The customer's order can be confirmed by Teleskop-Service in writing, verbally or electronically. Teleskop-Service is not obliged to confirm an order. (2) The contract is valid with reservations until the customer has received all of the ordered articles. Both parties can withdraw from the contract in case of substantial exceedance of delivery time by the suppliers of Teleskop-Service. Substantial exceedance of the delivery time is defined as four weeks past the delivery time stated at the time of the order / payment. Deviations from this can be set or accepted by Teleskop-Service at its own discretion. § 5. Costs/Shipment (1) The customer bears the costs of the articles including VAT (order value) including any additional costs. Shipping costs include a transport insurance. The items are shipped through UPS, the Postal Service or in the case of very large packets with a professional forwarder. (2) Shipping costs depend on the size and weight of the packet, the mode of delivery and of course the destination. § 6. Payment Terms (1) Payment is through cash on delivery, pre-payment by wire transfer, Paypal or credit card. Until the time of full payment all items remain property of Teleskop-Service. § 7. Obligations / Warranty (1) Teleskop-Service is not obliged to deliver any product ordered by a customer, especially in case of unavailability. (2) The customer is obliged to check the delivered products for completeness, visible damage caused by transport, other visible damages or wrong delivery. In case of visible transport damage the customer is to insist on a confirmation by the delivery person in order to enable later damage claims. Hidden transport damages or wrong deliveries are to be indicated within 24 hours after receipt in writing (by letter or fax) or electronically (E-Mail) to Teleskop-Service. (3) Hidden damages or defects are to be indicated within 24 months of receipt of the product according to legal warranty regulations. The exact manner and extent of the damage or defect is to be stated. § 7 (2) p. 4 + 5 applies. (4) If the delivered product is damaged or defective and the damage or defect has been indicated and described by the customer within the legal warranty period, and if § 7 (2) p. 4 + 5 applies Teleskop-Service can correct the damage or exchange the damaged product. If the repair or replacement cannot be made within a reasonable period the customer has the right to withdrawal from the contract or reduction of the price. (5) Teleskop-Service is not liable for any damage caused by improper use or handling by the customer or a third party. § 8. Information Storage (1) Teleskop-Service stores, processes and uses personalized information of the customer as far as they are needed for beginning, shaping or changing the contractual relationship. Furthermore Teleskop-Service stores, processes and uses payment information of the customer. Both happens under observation of legal regulations. (2) The customer and Teleskop-Service commit themselves to observe the legal regulations for data protection. § 9. Liability (1) Teleskop-Service is liable without reservations for any deliberately caused damage or damage through wanton negligence. (2) Teleskop-Service is liable in cases of product liability according to product liability laws as far as they apply to the respective service. (3) Teleskp-Service is not liable for any damage in any form caused by others. The customer releases Teleskop-Service from any liability. § 10. Final clauses / Redemption (1) If sections or individual terms of this statement are not legal or correct, the content or validity of the other parts remain uninfluenced by this fact. (2) The right of both Teleskop-Service and the customer to instant cancellation for grave reasons is not affected. (3) Until the time of full payment all items remain property of Teleskop-Service. If any damage occurs by the use of information presented there, only the author of the respective pages might be liable, not the one who has linked to these pages. (2) Teleskop-Service reserves the right not to be responsible for the topicality, correctness, completeness or quality of the information provided. Liability claims regarding damage caused by the use of any information provided, including any kind of information which is incomplete or incorrect,will therefore be rejected. |
